Notice of Public Hearing

NOTICE IS HEREBY GIVEN that Woodway’s 2022 preliminary budget has been filed. During the regular meeting on Monday, October 18, 2021 at 6 pm, the Woodway Town Council will hold a public hearing to take public input on the 2022 preliminary budget and will also hold a public hearing to take public input on the 2022 revenue sources. The public hearings will be held via Microsoft Teams. Any interested person(s) may provide oral and written public testimony regarding this issue at the virtual public hearing. Directions for participation in the virtual public hearing can be found on the Town’s website. Written comments may also be submitted prior to the public hearing to Heidi Napolitino, Clerk-Treasurer at heidi@townofwoodway.com. Comments received by noon on October 18 will be provided to the Council electronically for consideration at that evening’s meeting. Comments received after that deadline will be provided to the Council after the meeting. If for any reason this hearing cannot be completed, the Council may continue it to another date. No further notice of a continued hearing is required.

The Town of Woodway will attempt to accommodate any special needs of those wishing to attend.  If you require accommodation, please contact Town Hall a minimum of three (3) working days prior to the meeting date.

A Proclamation of Emergency

in the Town of Woodway

WHEREAS, the Mayor of the Town of Woodway has determined that the August 25, 2021, flooding of Town Hall and the resultant unforeseen risks of material damage to the building and to essential operations/functions of the Town constitute a disaster and an emergency under WMC Chapter 2.36 and RCW 38.52.070; and

WHEREAS, the Town of Woodway desires to take timely, reasonable and prudent measures to ensure the safety of our residents and our employees; and

WHEREAS, all available resources will be committed to perform necessary repairs; and

WHEREAS, the Town requires supplemental assistance because the potential severity of this problem is beyond the capability of our employees; and

WHEREAS, a Proclamation of Emergency is needed to allow the Town to spend public funds to take these measures; and

WHEREAS, a Proclamation of Emergency is needed to temporarily waive requirements of competitive bidding, public notice, and other administrative requirements, in order to expedite our response to this matter.

NOW, THEREFORE, I do hereby proclaim that this event constitutes a disaster and an emergency as defined by the Town of Woodway Comprehensive Emergency Management Plan and necessitates the use of emergency powers granted under RCW 38.52.070.

  1. I hereby appoint the Town Administrator as the Town’s disaster services coordinator and direct that he and department directors take actions deemed necessary to protect the health and safety of persons and property, including any necessary actions needed to obtain emergency supplies through municipal, county, state, or federal agencies.
  2. In order to prepare for, prevent, and respond to this disaster and emergency, pursuant to Chapter 2.36 WMC and RCW 38.52.070, the requirements of competitive bidding and public notice are hereby waived with reference to any contract relating to the Town’s lease or purchase of supplies, equipment, personal services, or public works as defined by RCW 39.04, or to any contract for the selection and award of professional and/or technical consultant contracts. Each Town department director is hereby authorized to exercise the powers vested in this proclamation in light of the demands of a dangerous and escalating emergency situation without regard to time consuming procedures and formalities otherwise normally prescribed by law (excepting mandatory constitutional requirements).
  3. A copy of this proclamation shall be posted on the exterior of Town Hall and shall be made available to members of the local news media and the general public.

The purpose of the public hearings is for the Town Council to consider public comments regarding amendments to the Urban Village Zone District (WMC 14.40) that will become effective upon annexation pursuant to RCW 35A.14.330-340.

Notice of SEPA Threshold Determination

Proposal: Adoption of the Amendments to the Urban Village Zone District (WMC 14.40) harmonizing density limitations with Snohomish County code and providing consistency with the provisions of RCW 35A.14.296 related to the annexation of land pursuant to an interlocal agreement.

Threshold Determination: The Town of Woodway has determined that the proposed amendments to the Urban Village Zone District (WMC 14.40) do not have a probable significant adverse impact on the environment, and on July 22, 2021 issued a Determination of Non-Significance.

Public Comment Period: The DNS was issued under WAC 197-11-340(2); the lead agency will not act on this proposal for 14 days from the date below. Comments must be submitted by August 6, 2021.
